MarqFit Community Guidelines & User Agreement

These are the key things you need to know before using MarqFit:
Welcome to MarqFit — a strength tracking and community fitness platform built exclusively for the Marquette University community. By downloading, installing, accessing, or using the MarqFit mobile application and all associated services ("App," "Service"), you ("User," "you," or "your") agree to be legally bound by these Terms of Service ("Terms").
Please read these Terms carefully before using the App. If you do not agree with any part of these Terms, you must not use MarqFit.
We reserve the right to modify these Terms at any time to reflect changes in our app, services, or applicable law. When material changes occur, we will notify you through an in-app notification and update the "Last Updated" date above. Your continued use of the App following notification of changes constitutes your acceptance of the updated Terms.
MarqFit is designed exclusively for the Marquette University community. To register, you must possess and verify a valid @marquette.edu email address. This requirement exists to protect the integrity, safety, and exclusivity of our community. Attempts to circumvent this requirement will result in immediate account termination.
You must be at least 13 years of age to use MarqFit. By using the App, you represent and warrant that you meet this age requirement and possess the legal authority to enter into this agreement.

You agree to keep all account information accurate, current, and complete. Providing false information, including a non-Marquette email address or falsified fitness data, violates these Terms.

MarqFit is not liable for any loss or damage arising from your failure to safeguard your account credentials.
Each user is permitted one account. Creating multiple accounts for any reason — including to circumvent a suspension — is a violation of these Terms and will result in permanent removal from the platform.
MarqFit is a community built on respect, accountability, and a shared passion for strength training. To maintain a safe and positive environment for all Marquette athletes and fitness enthusiasts, the following conduct is strictly prohibited:
Violations of these standards may result in a formal warning, temporary suspension, permanent account ban, and legal action where applicable.
MarqFit, including all source code, design systems, graphics, logos, the DOTS score algorithm, and all written content within the App, is the exclusive intellectual property of MarqFit and its developers. All rights are reserved. Your use of the App does not transfer any ownership rights to you.
We grant you a limited, non-exclusive, non-transferable, revocable license to use MarqFit strictly for personal, non-commercial fitness tracking within the Marquette University community. This license expressly does not permit you to:
By submitting content to MarqFit — such as workout posts, comments, or club interactions — you retain full ownership of that content. However, you grant MarqFit a limited, worldwide, royalty-free license to display, reproduce, and distribute that content solely within the App for the purpose of delivering the service to you and your club members. We do not claim ownership of your content and will not use it beyond this scope.
The personal records (PRs), workout history, and body metrics you enter into MarqFit are yours. We store and process this data exclusively to power your app experience — calculating your DOTS score, displaying your progress, and contributing to club leaderboards. This data is never sold, shared with advertisers, or used for any purpose beyond delivering the MarqFit service to you.
The DOTS (Dynamically Adjustable Percentile to Stride) score is a mathematical formula that adjusts your total strength output relative to your body weight, allowing fair comparisons across different body sizes. The accuracy of your DOTS score depends entirely on the accuracy of the data you enter. You are responsible for ensuring your personal records and body metrics are truthful and up-to-date.
Always consult a qualified physician before beginning any new training program, especially if you have pre-existing medical conditions. Always consult a certified strength and conditioning professional before attempting maximum effort lifts or significantly increasing training volume.
Your use of MarqFit is governed by our Privacy Policy, which is incorporated into and made part of these Terms. By using the App, you consent to our collection and use of your data as described in the Privacy Policy.

MarqFit allows users to join campus clubs, compete on club leaderboards, and share workout achievements with teammates. Club participation is voluntary. By joining a club, you agree to:
Club leaderboards display member usernames and DOTS scores for competitive and motivational purposes. Your placement on a leaderboard is determined entirely by your verified personal records. Submitting falsified PRs to gain leaderboard standing is a violation of these Terms and grounds for immediate suspension.
The auto-post feature, when enabled, automatically shares your workout completion to your club feed. This feature is entirely opt-in — it is never enabled by default. You may disable auto-posting at any time through the Settings menu, effective immediately. All push notifications are similarly opt-in and fully configurable in Settings.
Club leaders and administrators have the authority to remove members who violate community standards or club-specific rules. MarqFit reserves the right to dissolve, suspend, or remove any club that engages in conduct that violates these Terms or is harmful to the broader Marquette community.
Strength training — including Squats, Bench Press, and Deadlifts — carries inherent physical risks, including muscle strain, joint injury, and in extreme cases, serious bodily harm. MarqFit is a tool to track your training, not to supervise it.
By using MarqFit, you expressly acknowledge and agree that:

To the maximum extent permitted by applicable law, MarqFit and its developers shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of or inability to use the App — including, without limitation, loss of data, loss of progress records, or physical injury sustained during training.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of (a) $100 USD or (b) the total amount you have paid to us for use of the App in the twelve months preceding the claim. Some jurisdictions do not permit certain liability limitations; those provisions may not apply to you.
You agree to indemnify, defend, and hold harmless MarqFit, its founders, developers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to:
MarqFit integrates with a limited number of third-party services necessary for its operation:
We are not responsible for the availability, content, or privacy practices of these third-party services. We do not integrate with advertising networks, social media trackers, or data brokers.
You may terminate your MarqFit account at any time by requesting account deletion through the App's Settings menu or by contacting us at support@marqfit.com. Upon confirmed termination, your account and all associated personal data will be permanently deleted within 30 days, except where retention is required by law.
We reserve the right to suspend or permanently terminate your account, without prior notice, if you:
Upon termination of your account, your license to use the App is immediately revoked. All provisions of these Terms that by their nature should survive termination — including limitation of liability, indemnification, intellectual property rights, and governing law — shall remain in effect.
These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, USA, without regard to its conflict-of-law provisions.
You agree that any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Milwaukee, Wisconsin. You expressly waive any objection to such venue or jurisdiction on the basis of inconvenient forum.
Before pursuing any formal legal action, we strongly encourage you to contact us directly at support@marqfit.com. We typically respond within minutes to the same day and are committed to resolving concerns fairly and promptly. Most issues can be resolved through honest communication without the need for formal proceedings.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and MarqFit regarding the App and supersede all prior agreements, understandings, or negotiations. In the event of a conflict between these Terms and the Privacy Policy, these Terms shall prevail.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. We reserve the right to enforce our rights at any time.
You may not assign or transfer your account or any rights under these Terms to any other party without our express written consent. We may transfer our rights under these Terms in connection with a merger, acquisition, or sale of assets.
